Do fathers have a chance of getting child custody?

Family life in the United States of America has changed quite over the last few decades, including families in the Tustin, California, area. While in days past, the wife of a household would often have duties of maintaining the home and caring for the children while the husband is out all day or night working and earning an income for the family, things are different now.

With more women entering the workforce and maintaining their careers during a marriage these days, it is not uncommon for both parents to share child care or even for the father to stay at home to care for the children. The courts are aware of these changes in the roles of parents, and will look at each case individually when a couple files for divorce.

Even if a father is not awarded as the custodial parent, it is no longer assumed that his visitation time will be limited a few weekends each month and a couple weeks during the course of the year. Each situation is addressed individually, and if it can be proven that the father is the primary caretaker for the child, he may have a good chance of obtaining child custody. Obtaining custody as the father is not always easy, however.

While it is not uncommon for friends or family who have had experience with divorce to offer their opinions, it should be firmly understood that each person is different and each divorce will be handled differently as well. It is often in one's best interest to let a law professional familiar with divorce handle these situations in court. A lawyer can look at things your situation from a legal perspective and make opinions and suggestions on how to handle things without emotions that may sway you into an undesirable situation or court ruling, including child custody decisions.
